PACIFIC WEST CONFERENCE
CONSTITUTION
ARTICLE I
NAME
The name of this organization shall be the Pacific West Conference, hereinafter called the Conference.
ARTICLE II
PURPOSES AND FUNDAMENTAL POLICY
Section 1. The purposes of this Conference shall be:
A. To provide student-athletes the opportunity to compete at the highest level of competition in the Conference-offered sports commensurate with existing resources
B. To promote mutual trust and friendly intercollegiate athletics relationships among Conference members.
C. To promote the development of intercollegiate athletics programs based upon sound academic standards, principles of amateurism, good sportsmanship, and as an integral part of the educational programs of member institutions.
D. To stimulate programs developing leadership, physical fitness, sports participation as a recreational pursuit, and athletics excellence through intercollegiate programs.
E. To promote and regulate intercollegiate athletic programs and competition among member institutions in the belief that programs of competitive athletics, properly motivated and directed, make a unifying and stimulating contribution to the total educational function of collegiate institutions.
F. To further promote and provide visibility for Division II athletics within the scope of the Conference and the NCAA
G. To legislate, through Bylaws and Sports Regulations, and subjects of general concern to the membership.
H. To preserve the athletics records of the Conference.
Section 2. Fundamental Policy
It is the fundamental policy of the Conference that a member institution accept the philosophy and principles for the conduct of intercollegiate athletic programs of the National Collegiate Athletic Association (NCAA); that the legislation of the Conference shall apply to basic athletic issues such as admissions, financial aid, eligibility, and recruiting; and that member institutions shall be obligated to enforce and apply this legislation. Institutional failure to comply will result in sanctions
(refer to Bylaw Article 10).
Section 3. Provision for Dissolution
If, for sufficient reason, it becomes necessary to dissolve this Conference, the Council shall appoint a certified public accountant to examine the financial records. All liabilities will be assumed in equal shares by each member of the Conference. After all obligations and debts are paid, the remaining assets shall be distributed in equal shares to each member of the Conference.
ARTICLE III
MEMBERSHIP
Section 1. The members of the Pacific West Conference are:
Brigham Young University-Hawaii
Chaminade University
Dixie State College
Grand Canyon University
University of Hawaii-Hilo
Hawaii Pacific University
Notre Dame de Namur University
Section 2. The voting and other rights accruing to each institution are set forth in the bylaws of the Conference.
Section 3. Regular membership status may be granted to institutions outside of the Conference by written petition from the requesting institution. A two-thirds vote of the regular membership shall be required.
ARTICLE IV
NATIONAL AFFILIATIONS
Section 1. National Collegiate Athletic Association
The Conference is an allied member of the National Collegiate Athletic Association.
Section 2. National Collegiate Athletic Association Division II
Member institutions have designated their Conference-affiliated athletic programs as Division II for the purpose of competition in those sports in which the NCAA sponsors a national championship conducted under the division plan.
Section 3. National Association of Collegiate Directors of Athletics
The Conference is a sustaining member of the National Association of Collegiate Directors of Athletics.
ARTICLE V
OFFICERS
The Conference shall have officers as designated in the bylaws. The qualifications of officers, the method of their selection, and their respective powers and duties shall be set forth in the bylaws.
ARTICLE VI
BYLAWS
The Conference may adopt bylaws which shall be consistent with this constitution by a majority vote of the member institutions. Should there be any inconsistency between this constitution and the bylaws, this constitution shall prevail.
ARTICLE VII
AMENDMENTS
This constitution may be amended by a two-thirds vote of the regular membership of the Conference.
